More info, received later, from Larry Klayman:

He said the order is an outrage, with no reasoning. Judge referred to plaintiff as “Good Virgin. ” Will be appealed to Roy Moore’s (10 Commandment Judge) Supreme Court.  Larry feels the nation would experience total collapse under Obama.

The judge allotted 15 mins for the oral argument for both sides

It will be appealed.

But is he going to wait until than to file the appeal?

        • Don’t know.He is aware of Moore’s swear-in date. He can file it anytime with an understanding that hearing will wait until then. Not sure of deadlines.

I don’t know about the deadline for filing an appeal, but

December 11, 2012 – States must make final decisions in any controversies over the appointment of their electors at least six days before the meeting of the Electors

December 17, 2012 – The Electors meet in their state and vote for President and Vice President on separate ballots.

December 26, 2012 – The deadline for receipt of the electoral votes by the President of the Senate and the Archivist.

January 6, 2013 – The Congress meets in joint session to count the electoral votes on January 6, 2013.

January 20, 2013 at Noon—Inauguration Day – The President-elect takes the Oath of Office and becomes the President of the United States.

IANAL but it seems to me that after December 26th if not sooner, the Alabama Supreme Court loses jurisdiction.

          • Actually, inauguration is 1/21 this year, although Congress specifies 1/20 as effectivity date. Kinda moot, since it’s a re-election situation.

Not clear to me what happens if a case FILED before the deadline is not ruled on before the deadline, but I’m no lawyer and unfamiliar with the statutory details.

No, it is still 1/20. He is holding a “private” one on that day. The public “for show” one is the 21st.

          • I heard that they were doing the oath in private on the 20th, then doing the whole ceremony and repeating the oath on the 21st. Maybe Obama will swear on the Koran one day and the Bible the next. Or Das Kapital?

  2. The Alabama Supreme Court (nine justices, none of whom as of this date is Roy Moore) only has jurisdiction over Alabama. Alabama went red. So what is it that Klayman thinks the court can do? De-certify the votes for Romney?

After December 17, nothing. It becomes a Congressional matter after the Electoral College meets.
