Alaskan Files Suit Against Presidential Candidates, Cites Miller & Obama Senate Cases

Citing case law in both California and Alaska, Anchorage Resident Thomas A. Lamb has filed suit in the Superior Court of Alaska for access to private records for both President Barack Obama and Republican Nominee Willard “Mitt” Romney.

Lamb believes that precedent created by a 2004 California case instigated by Obama insiders requiring Illinois US Senate candidate Jack Ryan’s divorce records to be made public, and a 2010 Alaska case requiring personnel files for Alaska US Senate Candidate Joe Miller to be released, constitute grounds for further public disclosure of private documents for both major party’s presidential candidates.

Alaska Dispatch columnist Craig Medred appears to share Lamb’s sentiment, stating in correspondence earlier this year that the ruling in the Miller case “set a meaningful legal precedent that hopefully will be uniformly applied to everyone from here on.” It is unclear why the Alaska Dispatch and other media outlets who relentlessly pursued confidential information in the Miller case lack a similar level of intellectual curiosity when it pertains to the President of the United States.

Judge Winston Burbank’s edict in the Fairbanks North Star Borough case that the there is a compelling public interest in the voters “right to know” will be used to test the limits of Alaska’s explicit Constitutional “right to privacy.” Lamb hopes to compel the disclosure of school records, personnel files, medical information, and tax returns.

The suit stems from a request submitted to both candidates for the information in question. To date, there is evidence that both campaigns received the records requests, but neither has been forthcoming with information.

The impetus behind the inquiry? Among other things, Lamb cites suggestions from Democrat US Senate Majority Leader Harry Reid that Romney “manipulated” his tax returns, and the allegation that Barack Obama may have committed fraud by accessing financial assistance, purportedly as a foreign student. Sources for the claim against Obama include US and Indonesian law, the president’s own writings, and sworn affidavits.

If Lamb’s material claims are substantiated, it appears the president may have fraudulently received student aid from the federal government by making false claims about his legal status.

It is unlikely the case will get traction. But if it does, it is sure to draw national attention.

  1. The Constitution of the US sets out requirements for a person wishing to become President or Vice President of the USA. These are found in Article II sect 1 of that document.

    Curiosity had me wondering about other important factors as well…upstanding character, integrity, honesty, likes dogs, kids, apple pie, devoted family person, and other desirable features of what we have come to consider ‘Presidential timber”. I looked… and looked. Found lots of places revealing the requirements, but they were only those mentioned in the Constitution. Nothing about what was undesirable or disqualifying, for a President. I could only conclude from this……

    There are NO DISQUALIFICATIONS TO BECOMING PRESIDENT, OR VICE PRESIDENT, other than failure to meet the qualifications set out in the Constitution ! Meet those, and anyone can become President… IF he or she can get elected by We the People. Yes, even a felon, unless still in the slammer.

    The Founding Fathers (and authors of the Constitution) apparently left the determination of disqualifying traits of character, integrity, honesty, fidelity, and every other thing we hold for admiration and value in a person…left this determination to the VOTERS… We the People of the United States.

    We have such an example currently before us. A federal judge, in 2008, laid out the proper course of action in a trial questioning eligibility. Particulars may be gleaned from the following link:

  2. As an independent I really wasn’t sure who to vote for in this election so I set out to gather information to help me decide. I studied many articles, watched videos, etc. online to try to distinguish which candidate should get my vote.
    In the information I found, I was flabbergasted to learn that the United Auto Worker’s Union was alleging that Mr. Romney had profited from the auto industry bailout to the tune of between 10 and 115 million dollars, through his partnerships with other investors, who closed down Delco (auto parts exclusive to the big 2) and filed bankruptcy, then shipped those manufacturing tasks to China. They believe that the money in offshore accounts is, in fact, the profit Romney made from such dealings. I learned a lot about venture capitalist and how their game works, which, as a tax professional, I now understand the need for the offshore accounts. “Loan proceeds” are not generally taxable income, so if you buy a company for pennies on the dollar, load it with loans and debts, then take that cash and divide it up betwixt yourself and your ‘investors’, then it’s entirely appropriate to close the business and move the operation to China? Wow! Well and technically, the proceeds of those loans are not taxable, even though the intent for the loan could come into question somewhere, I’m sure. At any rate, I was amazed that none of the media had ran this story. Then I learned that the suit was actually filed in August, which made it even more curious as to why the media hadn’t latched on.
    On the other side of the battle for the white house, I learned some interesting things from the birthers and conspiracy theory people about Mr. Obama. So much rumor and speculation – everything from him being the son of Malcolm X (and they do look alike) to him being sponsored and brought up through the ranks to give muslims the edge in ‘taking over the United States’. it’s a crazy world folks! I guess the media weeded both out, as nothing’s come up on a major site for either of them, as far as being found out for ‘truth’. Curious, aye ?
