230:20-5-2. Time for filing contest

A contest of candidacy petition must be filed no later than 5 p.m. on the

second day following the close of the filing period. [26:5-119]

 

And filing for president was December 5-7, 2011.

 

This would appear to be a catch 22 to avoid challenges.  More than likely this

caveat would be upheld in any challenge.  How to go around this . . .??

 

Perhaps there is a clause in OK statutes that deal with fraud or false swearing

and bring that to placement of a U. S. Constitution unqualified candidate on the

ballot??

Comment: 
It looks like OK is pretty simple, assuming PBO is the only Dem on the ballot, 
if not get one of the other candidates to file.  Or get someone on the ballot as 
a dummy and have them  file.  The challenge in OK goes thru the elections board 
by way of the secretary, i.e. not to the SOS.

         Section 5-117 - Declarations of Candidacy Must be Accepted - Exceptions
The secretary of any election board shall accept any Declaration of Candidacy 
which the secretary is authorized to accept, except such Declaration which on 
its face shows that the candidate does not meet the qualifications to become a 
candidate for the office set forth as contained in the Oklahoma Constitution, 
statutes or resolution calling the election. Such acceptance shall entitle the 
candidate to have the candidate's name appear on the appropriate ballots unless 
the candidate withdraws candidacy according to law, or unless a contest to said 
candidacy is sustained in the manner hereinafter described.

              Section 5-118 - Contests of Candidacy
Any candidate, hereafter referred to as petitioner, may contest the candidacy of 
any other candidate for the same office, hereafter referred to as contestee, by 
filing a written petition with the secretary of the election board with whom 
said candidate filed the declaration of candidacy. In the event only one 
candidate files for an office, a petition contesting the candidacy may be filed 
by any registered voter who is eligible to vote for the candidate.
