The law allows for a process to challenge a candidates eligibility as per UCA 20A-9-202(5)(a). Keep in mind this applies only to those candidates who are required to file a declaration of candidacy form during the dates of March 9 through March 15, 2012.
Party candidates whose party will not participate in the primary process will be certified directly by the national or state party, and therefore do not have a requirement to file a declaration of candidacy. The statute does not provide a process to challenge candidates who are certified in this manner.

If this is that only statute, the Democratic party would have to be sued directly. Notice that this is another state that tries to shirk its duties to vet Presidential candidates.
